Terms of Use

These terms govern your access to and use of teckpath.com and related TeckPath online services.

These Terms of Use (“Terms”) are a legal agreement between you and TeckPath Information Technology Solutions Ltd. (“TeckPath,” “we,” “us,” or “our”). By accessing or using our website at teckpath.com and any related pages, forms, or online tools (collectively, the “Site”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

TeckPath is a managed IT, cybersecurity, compliance, and cloud services provider serving businesses in Canada and elsewhere. Separate written agreements govern paid client services. Where those agreements conflict with these Terms, the client agreement controls for that engagement.

1. Eligibility and account responsibility

You may use the Site only if you can form a binding contract and comply with applicable law. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of any credentials you use on the Site and for all activity under those credentials.

2. Permitted use

You may use the Site for lawful business and informational purposes, including reviewing our services, submitting inquiries, downloading resources we make available, and communicating with TeckPath.

You agree not to:

  • Use the Site in any way that violates law or third-party rights
  • Attempt to gain unauthorized access to systems, accounts, or data
  • Probe, scan, or test the vulnerability of the Site except under a written authorization from TeckPath
  • Interfere with or disrupt the Site, servers, or networks connected to the Site
  • Scrape, harvest, or automate access to the Site in a manner that imposes an unreasonable load or bypasses technical controls
  • Upload malware, spam, or harmful code
  • Misrepresent your identity or affiliation

3. Website information and professional advice

Content on the Site is provided for general information only. It does not constitute legal, financial, insurance, or other professional advice, and it is not a substitute for an assessment of your specific environment.

While we work to keep information accurate and current, we make no warranties that Site content is complete, error-free, or suitable for any particular purpose. Operational, security, and compliance requirements vary by organization. Decisions you make based on Site content are at your own risk.

4. Intellectual property

The Site and its content, including text, graphics, logos, icons, images, software, and design, are owned by TeckPath or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Site content except as permitted by law or with our prior written consent.

TeckPath, product names, and related marks are trademarks of TeckPath Information Technology Solutions Ltd. or their respective owners. Use of our marks without permission is prohibited.

5. Submissions and communications

When you submit information through contact forms, support requests, demo requests, job applications, or similar channels, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.

We may use submissions to respond to you, provide services you request, improve our operations, and comply with law. Our use of personal information is described in our Privacy Policy.

Do not submit confidential, regulated, or sensitive client data through general website forms unless we explicitly instruct you to do so through a secure channel.

6. Third-party links and services

The Site may link to third-party websites, tools, or services. TeckPath does not control and is not responsible for third-party content, privacy practices, availability, or security. Your use of third-party services is subject to their terms and policies.

7. Availability and changes

We may modify, suspend, or discontinue any part of the Site at any time without notice. We do not guarantee uninterrupted or error-free operation. Maintenance, outages, and events beyond our reasonable control may affect availability.

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the Terms were most recently revised. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

8. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site is provided on an “as is” and “as available” basis. TeckPath disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by applicable law, TeckPath and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, TeckPath’s total liability for claims arising out of or related to the Site will not exceed one hundred Canadian dollars (CAD $100), except where liability cannot be excluded or limited by law.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnity

You agree to defend, indemnify, and hold harmless TeckPath and its personnel from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site, violation of these Terms, or violation of applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Alberta, Canada, for disputes arising from these Terms or the Site, subject to any mandatory consumer protection rights that apply where you reside.

SMS terms of use

These SMS Terms of Use (“SMS Terms”) govern your use of TeckPath’s text messaging services (“Text Message Service”). By opting in, responding to, or using any Text Message Service offered by TeckPath, you agree to these SMS Terms and to TeckPath’s website Terms of Use and Privacy Policy.

1. Introduction

TeckPath Information Technology Solutions Ltd. (“TeckPath”) may send SMS or MMS messages for service-related communications. Our address is 160 Quarry Park Blvd SE, Suite 300, Calgary, AB T2C 3G3. Support: 1.800.772.8593.

2. Definitions

Opt-in / opting in: Any action by which you request, consent, or agree to receive SMS or MMS messages from TeckPath.

Text Message Service: Any communication sent by TeckPath via SMS, MMS, or successor technologies.

3. Acceptance

By opting in, you confirm that you agree to these SMS Terms, TeckPath’s Terms of Use, and Privacy Policy; and that you are the account holder or authorized user of the mobile number provided.

4. Electronic communications consent

By opting in, you consent to electronic records documenting your agreement. You may withdraw consent at any time by replying STOP.

5. Required opt-in disclosures

To comply with messaging regulations, TeckPath’s opt-in message will include:

  • Opt-out: “Reply STOP to unsubscribe.”
  • Frequency: “Message frequency varies based on your service interactions.”
  • Help: “Reply HELP for assistance.”

These statements are shown at the point of opt-in via web form, SMS prompt, or other consent-based trigger.

6. Use of the Text Message Service

TeckPath uses SMS for security alerts, service updates, appointment reminders, account notifications, and client support. Message frequency varies depending on user interactions and service engagements. TeckPath does not use SMS for third-party marketing.

7. Message costs

TeckPath does not charge for SMS messages, but standard carrier message and data rates may apply.

8. Opting out

To stop receiving messages from TeckPath, reply with any of the following: STOP, UNSUBSCRIBE, CANCEL, QUIT, END, REVOKE, or OPT OUT. Opt-out applies to the specific TeckPath number or program you were communicating with. A confirmation message will be sent.

9. Support

Reply HELP at any time for support contact information, opt-out instructions, and a summary of messaging rules. You may also contact [email protected] or 1.800.772.8593.

10. Limitations of liability

TeckPath is not responsible for undelivered, delayed, or failed messages; carrier disruptions; or incorrect numbers provided by users.

11. Modifications

TeckPath may update these SMS Terms at any time. Continued use of the Text Message Service after changes become effective constitutes acceptance.
